Anne Robinson and John King recently presented a key paper titled Charity and Not-for-Profit Sector Reform in Australia: Where to from here? The presentation was to the Society of Trust and Estate Practitioners (STEP) NSW Branch on Wednesday 16 November 2011.

The paper has been adjusted for broader readership and is a valuable and comprehensive overview of the current federal reform and, as well as outlining the background to the reform and its scope, includes discussion and commentary on five critical elements of the reforms:

  • new rules on Public Ancillary Funds;
  • the new Unrelated Business Income tax and related measures;
  • the re-statement of the "In Australia" conditions for tax concession entities;
  • the introduction of a statutory definition of "charity";
  • the establishment of the Australian Charities and Not-for-profit Commission (ACNC).
